Terms of Sale

Thank you for choosing to shop with Marbcon Inc. (“we,” “us,” “our”) via www.marbcon.com (the “Website”). These Terms of Sale (“Terms”) govern your purchase of products from Marbcon Inc. By placing an order through our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using our services or making any purchases.

1. Order Acceptance and Cancellation

1.1 Order Confirmation
All orders you place on the Website are subject to acceptance by us. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason, including but not limited to inaccuracies, errors in product or pricing information, or if we are unable to fulfill your order. If your order is canceled after your payment method has been charged, we will issue a refund in the amount of the charge.

1.2 Order Modifications
Once you have placed your order, any changes or modifications are subject to our approval. If you need to modify or cancel your order, please contact our Customer Service team as soon as possible. We cannot guarantee that we will be able to accommodate your request once the order has been processed.

All prices displayed on our Website are quoted in U.S. Dollars (USD) unless otherwise stated. These prices do not include sales tax, use tax, value-added tax (VAT), customs duties, or any other applicable taxes or fees unless explicitly noted. Such additional charges may be added during checkout.

3. Taxes and Duties

4. Shipping and Delivery

4.1 Shipping Locations
We currently ship within the United States. For international shipping inquiries, please contact our Customer Service team to confirm availability and rates.

4.2 Shipping Costs
Shipping costs vary based on the product weight, size, and shipping destination. These costs will be displayed at checkout prior to the completion of your order.

4.3 Delivery Times
Estimated delivery times are provided during checkout. While we strive to meet these estimates, actual delivery times may vary due to factors beyond our control (e.g., weather, carrier delays, holidays, etc.). Marbcon Inc. is not responsible for any shipping delays once the items have been handed over to the carrier.

4.4 Risk of Loss
Title and risk of loss for any purchased items pass to you upon our delivery to the carrier. If you experience any issues with shipping or have questions about your delivery, please contact our Customer Service team.

5. Returns, Refunds, and Exchanges

5.1 Return Policy
We want you to be completely satisfied with your purchase. If for any reason you are not, you may return eligible items within 14 days from the date of delivery. Items must be in new, unused condition with all original packaging, accessories, and documentation.

5.2 Exclusions
Certain products may be non-returnable or subject to different return policies. Any such exclusions will be noted on the product page or explained during the purchase process.

5.3 Return Shipping
Unless the item arrived damaged or defective, you are responsible for the cost of return shipping. We recommend using a trackable shipping service. We are not responsible for returns lost in transit.

5.4 Refunds
Refunds are issued to the original payment method once returned items are received and inspected. Shipping fees (if any) are non-refundable unless the return is due to our error (e.g., incorrect or defective product).

5.5 Exchanges
For exchanges, please contact our Customer Service team to ensure product availability. You may need to return the original item first, and then place a new order for the replacement product.

6. Warranty

6.1 Manufacturer’s Warranty
Some products sold on our Website may come with a manufacturer’s warranty. Any warranty claims or inquiries should be directed to the product’s manufacturer. We do not provide additional warranties beyond those offered by the manufacturer, except where explicitly stated.

In no event shall our aggregate liability exceed the total amount paid by you for the specific product or service in question.

These Terms of Sale and any disputes arising from or related to these Terms or your purchase of products from Marbcon Inc. shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal actions or proceedings arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in  New Jersey, and you hereby consent to the personal jurisdiction of such courts.

By placing an order through our Website, you consent to receive electronic communications from us (e.g., via email). You agree that any such notices, disclosures, or other communications satisfy any legal requirement that such communications be in writing.
